RENTAL PERIOD

Rental period is 1 day unless otherwise noted. Prices are subject to change without notice and your prices are locked at the time reservation deposit is received. All rentals shall be on a cash or credit card basis unless you have a billable account with To The Moon Party Rentals.

DELIVERY BY LESSOR:

Lessee (customer), grants Lessor the right to enter the address specified for delivery and pickup of equipment. A To The Moon Party Rentals authorized representative may arrive as early as the ‘Start’ of the ‘rental period’ or as late as necessary to pick-up leased equipment. Lessee is responsible for all equipment until it is relinquished to a To The Moon Party Rentals authorized representative. Lessee is strictly prohibited from removing equipment from the property listed as the servicing/shipping address or moving installed tents for any reason. Lessor reserves the right to cancel scheduled event should the event location present potential hazards, unsafe conditions or restrict the proper set-up of leased equipment within To The Moon Party Rentals and manufacturer guidelines, state regulations, rules, policies, and procedures.

Standard delivery- Tables, Chairs, Yard Games, Concessions

• Standard deliveries occur on the day of the event and are scheduled for between 8 AM and 12 PM unless otherwise needed for an event and scheduled in advance. Standard Deliveries are picked up the following day unless a custom delivery is scheduled.
• Tables and chairs should be broken down and placed together before pickup.

Custom Delivery-Tables, Chairs, Yard Games, Concessions

• Custom deliveries are any deliveries that must be completed outside of our standard delivery times. (Same day Delivery/Pickup, Park setups, Hall Rentals, Etc.
• Tables and chairs should be broken down and placed together before pickup.

Tent Deliveries/Pickup

• Delivery and setup for tent rentals will be scheduled for the day before your event. Due to unforeseen circumstances tent rentals may be put up in the AM the day of the event. At time of delivery To The Moon Party Rentals will set-up the tent tables and chairs. The Linens will be provided to you upon delivery. Tables and chairs should be broken down and placed under the tent before pickup.

DAMAGE/ CARE OF RENTAL EQUIPMENT: Lessee shall be responsible for any and all damage to any of the Rental Equipment not caused by ordinary wear and tear. ‘Ordinary wear and tear’ shall mean only the normal deterioration of the rental equipment caused by ordinary, reasonable and proper use of the rental equipment. Lessee shall be liable to Lessor for any and all damage, which is not ‘ordinary wear and tear’ in an amount equal to the replacement value listed on the front of the agreement. Responsibility for equipment remains with the renter from time of delivery to time of return. Please be sure that equipment is secured when not in use, and protected from the weather. Additional charges will be assessed for missing, broken, or weather damaged items. All equipment must be returned clean with the exception of linens and concessions. In the event decorations are hung they must be removed from the equipment prior to pickup. Linens must be returned dry but do not need to be clean. Items returned dirty are subject to a cleaning charge.

CANCELLATION / REFUND POLICY: Refunds for the deposit will be returned in full if the reservation is canceled prior to (14) calendar days before event. The Lessor will not refund any reservation deposit should Lessee fail to provide a written cancellation request (via certified mail or Email to info@tothemoonrentals.com) prior to fourteen (14) calendar days before the rental date. A deposit of $50 for table a chair rentals, and $100 per tent reserved will not be refunded if cancellation is within 14 Days of the event. A credit to use within one (1) year will be provided if the event is cancelled due to a weather related event within 7 Days of the delivery date but not later than 48 Hours prior to the delivery dates. Refund or credits will not be issued in the event the leased equipment is unused for any reason. If the equipment does not work properly, it is the responsibility of the Lessee to notify the Lessor in a timely fashion to correct. Lessor reserves the right to cancel / postpone scheduled event for safety reasons (e.g., confirmed severe thunderstorms, hail, winds in excess of fifteen (25) mph, tropical depression, tropical storm, hurricane or tornado conditions) and will issue a full refund to Lessee for deposits and / or confirmed payments received. Should Lessee cancel event upon delivery, Lessee is subject to a minimum fee of $50.00 U.S.D. and forfeits any and all deposits. In the event Lessee request return of leased equipment after formal cancellation, Lessee is subject to an additional minimum delivery fee of $50.00 U.S.D. plus any delivery fees assessed, based on location of event, on the initial Rental Agreement. Lessee is responsible for monitoring weather conditions throughout the rental period for safe operations.

EXPRESS ASSUMPTION OF RISK The undersigned hereby agrees that he/she is renting, operating or using the equipment provided by To The Moon Rentals at his/her own risk. The undersigned agrees that he/she is voluntarily participating in all activities related to the rental, operation, or use of the rental equipment, and assumes all risk of injury, illness, damage or loss that might result, even if the risks arise out of the negligence or fault of ‘To The Moon Party Rentals.

WAIVER/RELEASE OF LIABILITY By the execution of this release, the undersigned agrees that To The Moon Rentals shall not be liable for any damages arising from personal injuries sustained as a result of any and all activities related to the rental, operation, or use of equipment provided by ‘To The Moon Party Rentals’. The undersigned assumes full responsibility for any such injuries or damages which may occur, and further agrees that To The Moon Rentals shall not be liable for any injuries, damages, loss or theft of personal property.

SEVERABILITY: If any of the terms or conditions of this Agreement are found to be unenforceable, illegal or unconscionable by a court of competent jurisdiction, such item shall be stricken from this Agreement, and the remaining terms and conditions of this Agreement shall stay in full force and effect.

ACKNOWLEDGEMENT: The Lessee acknowledges and certifies that it has had sufficient opportunity to read this entire document, and understands its content and that it was executed freely, intelligently and without duress of any kind and agrees to be bound by its terms. Lessee further warrants and represents that they are either the Lessee named above or are authorized and empowered to accept delivery of the equipment and to sign this Agreement on the Lessee’s behalf and as the Lessee’s agent. Furthermore, Lessee agrees that they are binding themselves personally as an additional party to all of the terms and conditions of this Agreement.
